I bought a car from an ex friend last year and we agreed that i could pay £100 a month and that the car would be signed over on final installement. there was no contract written up for this agreement. only a few emails saying i would pay monthly
so i payed each month as we agreed. but never asked for a receipt for the money .
on 30th june there was some confusion about how much was paid and i emailed him saying i owed £400 which they then agreed was correct.
i took that £100 to them that night and again in july, august, and final payment in september which was the day they signed the car over to me. but again there was no receipt written
there now using that email i sent saying i owe £400 and saying as i have no receipt to proove of additional payments then i still owe £400.
ive recently sold the car as it would not run
any help is really appreciated

everything was paid in cash so there is no evidence that any money was or wasnt ginen / received

Witnesses to the verbal contract? You taking over the £100? I am assuming you have kept the e-mail you sent him regarding the outstanding balance (does it have a date on it?), so these things might be useful if you want to get the law book out and throw it at him.
Also, if you bought the car in good faith, under the impression it was a good runner, and it wasnt then its false advertising, and wasnt worth however much you paid for it. Have you got any receipts or info from a garage etc that may have looked at the car and certified it as a non-runner?
Alternatively, tell him to get a grip and stop being such a scam artist. |

the email i sent him was dated 30 th june and yes i still have that one
my partner remembers me leaving the house each time to goto his to pay him but she never saw any monies change hands
i dont have any info from a garage saying that it was a non runner, but i did sell it on ebay as a non runner and the person who bought it from me understood this, thats why i sold it about 3 months later for a 3rd of what i paid for it.
the reason it wasnt sold on for 3 months is because i stored it in the garage once it blew up as i didnt think i will be able to sell it
the most annoying thing is ive asked them 4 times today alone to stop emailing me but they send me an email every 10 mins and its doin my head in.
so i need as much advice as possible, for 2 reasons
to shut them up
and so i can stop worrying about it |

At the end of the day, you are totally in the right, they are not. Verbal contracts still stand. You paid all of the money, and they know it. Was he still your friend until it all got nasty, or did you stop being friends with him whilst still making monthly payments?
If they are e-mailing you that much, it is harassment- so you have the choice to involve the police, hopefully before they do. Explain the situation in full, give them as much info as possible and then leave the rest up to them.
In the meantime, save every e-mail they send you, and vice versa, and keep a log of dates and times of contact so you can prove they are harassing you. |

we were friends for about 2 months after then they got funny and said my partner was not doing a good job cleaning there flat any more so they agreed she would leave. it was after this that he got real funny.
if you knew my partner she would not rip anyone of and i know he only said this as she got the flat uptogether and wanted to find a way for her to leave.
im at my wits end and just dont know what to do |

Dont sweat it, go to the police tomorrow, or whenever you can and explain it to them. They might direct you to the nearest Citizens Advice Bureau, who are absolute legends with things like this. Between the cops and the C.A.B. youll be fine as Ive used them many times for similar things.

tbh mate this is why im so peed of with the matter
normally i would have just gone round there but he such a smart arse i know i would end up re arranging his smug face, then i would be in deep doodoo im sure he would take me to court for that.
he sent another email 5 mins ago and i asked him to stop and guess what just got another so im goin to police tomorrow to see what they gotta say on the matter.
he has said that he is going to speak with his solcitor tomorrow and said he will get papers served on me , or something like that |

just got this from a couple of people who know a little about the law, what do u guys think
If they signed the car over to you, you had Possession and Title. The payment doesn't matter anymore.
YOU are the LEGAL owner with TITLE.
And now that you've sold the car, the case should be closed.
You Win....'nuf said.

Let them blow smoke for as long as they want. They have no case against you. There was no written agreement, no documentation, no proof of any payment arrangement. They have nothing to go on so there can be no lawsuit.

please be advised that unless I hear from you by 5pm Monday January 25th 2010 with a formal, positive plan to from you to repay this long outstanding debt, I reserve the right, without any further notification, to commence immediate legal proceedings against you for full recovery off this debt plus interest & costs, which could be very expensive.
Matt, I regret having to take this action, however your inability to offer payback of this debt leaves with with no option.
Under no circumstances should you ignore this email.

However, the comments above are true, get the police involved asap and you cant go wrong.
Besides, why would they have signed the car over to you if you didnt pay for it? They've slipped up a bit there...

You refuse to provide me with details of your solicitor despite my requests.
I will not stop emailing you or demanding payment of what is owed to me until I have received from you a proposal to discharge this debt. You are in breach of our contract; a contract well documented via various emails from each of us to the other.

well citizen advice told me to email him asking for a copy of the contract that doesnt exist but he said he had
also proof of non payment which he said he has
at first he said it was £100 and then a few days later he increased it to £400 so i asked him to make this clear, as he seems unclear as to how much he thinks i actually owe
i sent him this email at 10am today and ive not heard anything as yet, and considering he sent me 15 emails in 2 hrs last night i think he is having a re think.
so we will see what happens |
