I bought a car from an ex friend last year and we agreed that i could pay £100 a month and that the car would be signed over on final installement. there was no contract written up for this agreement. only a few emails saying i would pay monthly

so i payed each month as we agreed. but never asked for a receipt for the money .

on 30th june there was some confusion about how much was paid and i emailed him saying i owed £400 which they then agreed was correct.

i took that £100 to them that night and again in july, august, and final payment in september which was the day they signed the car over to me. but again there was no receipt written

there now using that email i sent saying i owe £400 and saying as i have no receipt to proove of additional payments then i still owe £400.

ive recently sold the car as it would not run

any help is really appreciated

Additional Details
everything was paid in cash so there is no evidence that any money was or wasnt ginen / received

If he carries on I'd agree to see him in court. He can't prove that you didn't pay for the car, and he signed it over to you voluntarily which he wouldn't have done if you hadn't paid for it. He's also accused you of breaching a contract which doesn't exist, and even if you *did* owe him £400 that's all he'd be legally entitled to, he can't claim interest and "costs".

Basically he's talking through his arse.

yeah i told him that this was the advice cab gave me
and i still not heard nothing, either he bottled it or he waiting till monday lets see

I'm sure its tempting, but maybe not advisable, really hope you get it sorted.

yeah i told him that this was the advice cab gave me

call his bluff and tell him your willing to be taken a court,he will be out of pocket,the cars in your name so thats the end of it unless you had a hp agreement signed which you didnt.It amazes me what some people think they can get away with.

well citizen advice told me to email him asking for a copy of the contract that doesnt exist but he said he had
also proof of non payment which he said he has
at first he said it was £100 and then a few days later he increased it to £400 so i asked him to make this clear, as he seems unclear as to how much he thinks i actually owe

i sent him this email at 10am today and ive not heard anything as yet, and considering he sent me 15 emails in 2 hrs last night i think he is having a re think.

so we will see what happens

You refuse to provide me with details of your solicitor despite my requests.


I will not stop emailing you or demanding payment of what is owed to me until I have received from you a proposal to discharge this debt. You are in breach of our contract; a contract well documented via various emails from each of us to the other.

However, the comments above are true, get the police involved asap and you cant go wrong.

Besides, why would they have signed the car over to you if you didnt pay for it? They've slipped up a bit there...

please be advised that unless I hear from you by 5pm Monday January 25th 2010 with a formal, positive plan to from you to repay this long outstanding debt, I reserve the right, without any further notification, to commence immediate legal proceedings against you for full recovery off this debt plus interest & costs, which could be very expensive.


Matt, I regret having to take this action, however your inability to offer payback of this debt leaves with with no option.

If they signed the car over to you, you had Possession and Title. The payment doesn't matter anymore.
YOU are the LEGAL owner with TITLE.
And now that you've sold the car, the case should be closed.
You Win....'nuf said.

Let them blow smoke for as long as they want. They have no case against you. There was no written agreement, no documentation, no proof of any payment arrangement. They have nothing to go on so there can be no lawsuit.

tbh mate this is why im so peed of with the matter

normally i would have just gone round there but he such a smart arse i know i would end up re arranging his smug face, then i would be in deep doodoo im sure he would take me to court for that.

he sent another email 5 mins ago and i asked him to stop and guess what just got another so im goin to police tomorrow to see what they gotta say on the matter.

he has said that he is going to speak with his solcitor tomorrow and said he will get papers served on me , or something like that
